JEmployee ke Kanuni Adhikar kya hain?

Bharat mein har employee — chahe sarkari ho ya private — ko kuch buniyadi kanuni adhikar milte hain. Agar employer in adhikaaron ka ullanghan kare to employee kanoon ka sahara le sakta hai.

Mukhya Labour Laws Bharat mein

  • Industrial Disputes Act, 1947 — naukri se nikalne aur hadata ke mamle
  • Payment of Wages Act, 1936 — samay par tankhwah milne ka adhikar
  • Minimum Wages Act, 1948 — nyunatam vetan ka adhikar
  • Gratuity Act, 1972 — 5 saal baad gratuity milne ka adhikar
  • Provident Fund Act — PF ka adhikar
  • Maternity Benefit Act — mahilaon ke liye maternity leave
  • POSH Act, 2013 — kaaryasthal par yaun utpeedan se suraksha

Bina Notice ke Naukri se Nikale to Kya Karein

Agar aapko bina karan bataye ya bina notice ke naukri se nikaala gaya hai to yeh wrongful termination hai. Aap:

  1. Pehle HR ya management ko written complaint dein
  2. Labour Commissioner ke paas shikayat karein
  3. Labour Court mein case file karein
  4. Industrial Tribunal mein jaayein

Labour Court mein Case Kaise File Karein

Step 1 — Notice Period aur Dues Check Karein

Pehle yeh dekhein ki aapko notice period ka paise mila ya nahi, pending salary mili ya nahi, PF aur gratuity clear hua ya nahi.

Step 2 — Labour Commissioner Office

Apne city ke Labour Commissioner ke paas jaayein. Yahan conciliation ki koshish hogi. Agar nahi suli to case Labour Court mein jaata hai.

Step 3 — Industrial Disputes Act ke tahat Complaint

ID Act ke tahat aap reinstatement (wapas naukri) ya compensation maang sakte hain.

Agar employer salary nahi de raha:

  • Payment of Wages Act ke tahat Labour Authority mein complaint karein
  • Online: Shram Suvidha Portal par complaint darj karein — https://shramsuvidha.gov.in

Sexual Harassment at Workplace (POSH)

Agar kaaryasthal par yaun utpeedan ho to Internal Complaints Committee (ICC) mein shikayat karein. Agar company mein ICC nahi hai to Local Complaints Committee (LCC) — jo District Collector ke office ke under hoti hai — mein complaint daalein.

PF Withdrawal aur Pension

Naukri chhodne ke baad PF online withdraw kar sakte hain — https://www.epfindia.gov.in par. UAN number se login karein aur online claim submit karein.
